If you're planning to run a business under a name that isn't your own personal name, registering a business name is a legal requirement. Below are answers to the most common questions we receive about registering a business name in Australia.

Do I Need to Register a Business Name?

Yes — if you're operating as a sole trader or partnership and want to trade under a name that’s not your legal name, you must register it.

For example:

  • ✅ “Samantha Lee” – no registration needed

  • ❌ “Samantha’s Creative Cakes” – must be registered

Registering a business name also helps with branding, marketing, and establishing your business identity.

  • $199 for 1 year (includes ASIC’s $44 fee)

  • $297 for 3 years (includes ASIC’s $102 fee)

Can I Register a Business Name if I’m Not an Australian Resident?

To register a business name, you must:

  • Hold an Australian Business Number (ABN)

  • Be a resident for tax purposes (i.e. have a Tax File Number)

If you don’t have an ABN yet, we can help include it in your business name registration.

When Do I Need to Renew My Business Name?

Business names must be renewed:

  • Every 1 year (if registered for 1 year)

  • Every 3 years (if registered for 3 years)

We’ll notify you 30 days before expiry and follow up to help ensure timely renewal.

How Long Does Registration Take?

Once your application is submitted, ASIC usually processes the business name within 3–5 business days. As soon as your certificate is available, we’ll email it directly to you.

When Can I Start Using My Business Name?

You can start using your business name only after it's officially approved by ASIC. To avoid costly reprints, wait until you receive your registration certificate before producing business cards, signage, or merchandise.

Can I Register More Than One Business Name?

Yes. You can:

  • Add multiple names in a single application

  • Register them under the same ABN

  • Or contact our team to register by phone

Will I Receive a Certificate?

Yes — once ASIC approves your business name, we’ll email you a digital registration certificate.

Is an ABN Required?

Yes, an ABN is a mandatory requirement to register a business name. If you don’t yet have one, we offer combined ABN + business name registration as part of our service.

What if the Name I Want is Already Registered?

You’ll need to choose a different, available name. We suggest modifying your preferred name by:

  • Adding a location (e.g. “Creative Cakes Sydney”)

  • Including a unique word or phrase

Do I Need a Business Bank Account?

Sole traders can use a personal account, but we recommend setting up a separate business account to:

  • Keep your records clear

  • Simplify accounting and tax lodgement

Can I Keep My Address Private?

Yes. You can request address suppression by contacting ASIC directly on 1300 300 630.

Is My Business Name Registered Nationwide?

Yes — business names registered through ASIC are valid across all Australian states and territories.

If you're looking to register a business name overseas, we recommend contacting ASIC for guidance.

Why is Your Email on My Registration Certificate?

As your ASIC agent, we manage all communication with ASIC on your behalf. This ensures you don’t miss important updates or notices.

If you'd prefer to use your personal email instead, we can update it — however, this will remove us as your registered ASIC agent.

Is the Business Name Fee Tax Deductible?

  • Your initial registration fee is considered a capital expense and can usually be claimed over 5 years (20% per year).

  • Renewal fees are generally 100% tax deductible in the year they’re paid.

Restricted Words or Expressions

If your chosen name contains restricted terms (e.g. “bank,” “university,” “royal”), you may need special ministerial consent to proceed.

What’s the Difference Between a Business Name and a Trading Name?

Trading names were used prior to 2012 and are now being phased out. Since 2018, they are no longer displayed on the ABN Lookup.

To legally operate under a business name in Australia, it must be registered with ASIC.
